The following Terms of Service (“Terms” and/or this “Agreement”) are between you, or the company you represent, as a user (“User,” “You,” and/or “Your”) and Bison Junk Removal & Hauling and its affiliates (“Bison,” “us,” “we,” and/or “our”) and govern your access to and use of our website, communications, and related services (collectively, our “Services”).
By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to be bound by these Terms, you must not use or access our website or Services. These Terms may be updated periodically, and your continued use constitutes acceptance of the modified Terms.
1. Our Services
Bison provides junk removal, hauling, donation pickup, and related labor services within our service areas in Washington. Users acknowledge that our team performs services subject to availability, scheduling, and confirmation.
We are not a licensed waste collection utility; you acknowledge we may not be subject to the same regulations as municipal waste collection providers. You must be at least eighteen (18) years of age to book or use our Services.
2. Your Acknowledgments
By placing an order, you request that Bison coordinate, schedule, and perform the requested Services. You acknowledge that engaging our Services is at your discretion and that Bison makes commercially reasonable efforts to perform services safely and professionally.
You are solely responsible for complying with all applicable federal, state, and local laws when requesting Services.
3. Your Representations
By using our website and/or placing an order, you warrant and represent that you: have read and agree to be bound by these Terms; reside in the United States or its territories; own or have legal possession of all property to be hauled, removed, or serviced; have the financial capacity to fulfill payment obligations; will provide information that is true, accurate, current, and complete; and have the legal capacity to enter into and comply with these Terms.
4. License to Use the Site
We grant you a limited, revocable, non-transferable, non-exclusive license to access and use our website solely for its intended purposes, subject to these Terms. This license terminates automatically upon any breach of these Terms.
5. Restrictions on Use
You agree that you shall not: license, sell, or exploit the website or Services; reverse engineer or copy any part of the website; use the website for any illegal purpose or to transmit unlawful material; impersonate any person or entity; interfere with or disrupt the website or its servers; use automated means such as bots or scrapers without written permission; or attempt to gain unauthorized access to any related systems or networks.
6. Proprietary Material
All rights, title, and interest in the website, including all intellectual property, content, features, logos, and trademarks, are and remain the exclusive property of Bison Junk Removal & Hauling. You obtain no interest in our intellectual property by using the website or Services, and you may not use our marks without prior written permission.
7. Termination and Suspension
Bison reserves the right to immediately suspend or terminate your access to the website and Services, including any account, at any time and for any reason, including violation of these Terms, illegal or fraudulent activity, or misuse of the Services.
Upon termination, you must cease all use of the website and Services. Provisions relating to indemnification, limitation of liability, proprietary material, dispute resolution, payment obligations, and any terms that by their nature should survive will continue after termination.
8. Placing Orders
By placing an order, you represent that you have the legal authority to do so and that all information provided is accurate and complete. You authorize Bison to charge your payment method for the total amount due, including applicable taxes and fees, and acknowledge that additional charges may apply if the scope of Services changes.
All orders are subject to acceptance. We reserve the right to refuse or cancel any order at our sole discretion for reasons including availability, pricing errors, or suspected fraud.
9. Availability, Errors, and Inaccuracies
Our website may occasionally contain errors, inaccuracies, or omissions and may not be complete or current. We reserve the right to correct any errors and to change or update information at any time without prior notice, including after you have submitted an order. Your sole remedy for any material error is to discontinue use of the website.
10. Pricing
Pricing is for the Services made available to you and is subject to change at any time. Pricing may vary based on factors including demand, location, and service type. Except for situations involving inaccurate information, we will not change pricing on an order already placed and confirmed, provided that order remains unchanged. All prices are exclusive of applicable taxes, fees, and surcharges.
11. Payment Terms
To purchase Services, you must provide accurate, complete, and current payment information. You authorize us and our payment processors to charge your payment method for all fees and charges incurred under these Terms, including applicable taxes and any additional charges.
You warrant that you have the legal right to use the payment method provided and are responsible for maintaining its security. Subject to the refund policy below, all payments are non-refundable unless otherwise specified in writing. All payments shall be made in U.S. dollars.
12. Rescheduling, Cancellations & Refunds
You may reschedule your Services before your scheduled window at no penalty; however, rescheduling may affect applicable cancellation fees. Cancellations made prior to the day of Service incur a 20% fee; cancellations on or after the day of Service, or after rescheduling, incur a 50% fee. All fees are calculated on the total order value at the time of cancellation.
For issues concerning the performance of your Services, you must notify us in writing within twenty-four (24) hours after the service started. Refunds, if any, are issued at our sole discretion and, when approved, are processed to the original payment method within 5–7 business days. 13. Service Windows
While we strive to provide timely Services, we cannot guarantee specific service windows, times, or dates. Service times are estimates and may change due to weather, traffic, vehicle issues, availability, or events beyond our reasonable control. You are responsible for being available during the entire service window, and we are not liable for delays caused by your unavailability or inaccurate information.
14. Accessibility and Disassembly
You are solely responsible for ensuring that all items are fully accessible and can be safely removed without extensive disassembly or damage to property. Additional charges may apply for unexpected disassembly or accessibility challenges not disclosed at booking. By placing an order, you represent that all items are safely accessible and removable from your location.
15. Refusal of Service
We reserve the right to refuse or cancel an order at any time and for any reason, including if an item is contaminated or infested, if service would require structural alterations, if a location is unsafe or unsanitary, in cases of inclement weather, if a location is inaccessible, or if items cannot be moved safely through doorways, hallways, or stairs.
16. Disposal, Recycling & Donation
For removal Services, ownership of removed items transfers to Bison upon pickup, and you relinquish all rights to those items. We comply with applicable federal, state, and local laws when disposing of items. While we make every effort to donate or recycle items when feasible, we make no guarantees regarding donation or specific disposal methods, as condition, contamination, or facility availability may prevent it.
17. Privacy and Data Protection
Bison is committed to protecting your privacy and complies with applicable federal and Washington State privacy laws. We collect personal information such as your name, address, email, phone number, and payment details to schedule and perform Services. By using our Services, you consent to the collection, use, and processing of your personal information as described in our Privacy Policy. We do not sell your personal information to third parties.
18. Accounts
You may be required to maintain an active account to use certain features. You agree to provide accurate, current, and complete information and are solely responsible for maintaining the confidentiality and security of your account credentials. You are responsible for all activity that occurs under your account and must notify us immediately of any suspected unauthorized use.
19. Third-Party Links
Our website may contain links to third-party websites or services that we do not own or control. We disclaim all responsibility for the content, privacy policies, and practices of any third-party sites. These links are provided for your convenience only, and you access them at your own risk.
20. Making a Claim & Limitation of Liability
To the fullest extent permitted by law, our Services are provided “as is” without warranties of any kind, and our total liability for any claim is limited to the amount you paid for the specific Service at issue. We are not liable for pre-existing damage, ordinary wear, or items left outside the agreed scope of service. Claims must be submitted in writing to bisonjunkandhauling@gmail.com within the timeframes set out in these Terms.
21. Governing Law & Contact
These Terms are governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the state and federal courts located in Washington.
